Terms and Conditions

This page sets out the terms and conditions of Swiss Chocolate Chalet and governs the purchase of our products and use of our website.

1. Scope


1.1 These General Terms and Conditions apply to all orders placed by customers through the Choco Chalet AG website www.chocochalet.ch. Please read these General Terms and Conditions carefully before ordering products from this website. By ordering our products, you agree to the following terms.


1.2 At the end of the ordering process, please click the “I agree to the Terms and Conditions” button if you accept these Terms and Conditions. Please note that if you do not accept these terms of sale and delivery, you will not be able to order products from this website.


2. Offer and Conclusion of Contract


2.1 The products displayed in the online shop do not constitute a legally binding offer, but an invitation to place an order.


2.2 By clicking the [Place Order] button, the customer places a binding order for the products listed on the order page. Once the order has been submitted, the customer can no longer make changes to it.


2.3 Immediately after receiving the order, the Swiss Chocolate Chalet Online Shop will confirm receipt by email. The purchase contract is only concluded once the Swiss Chocolate Chalet Online Shop confirms shipment of the goods by email (order or shipping confirmation), or at the latest upon delivery of the goods.


3. Legal capacity


3.1 By placing an order on our website, you warrant that you are legally capable of entering into binding contracts and are at least 18 years old.


4. Prices


4.1 The prices stated on the product page include statutory VAT and any other price components and are given in Swiss francs (CHF).


4.2 The prices applicable to the products offered are those listed on the day the customer places the order. Prices are binding until the order is confirmed by the Swiss Chocolate Chalet Online Shop or for the period specified in the order confirmation.


4.3 Prices are subject to change in the event of changes to taxes, fees, charges or shipping costs.


5. Shipping costs


Delivery of the items ordered is at the customer's expense. Shipping costs comprise postage and packaging. They can be viewed at any time on the Shipping Information page/link and are displayed before checkout for domestic deliveries.


6. Delivery terms


6.1 Delivery is available throughout Switzerland. Delivery abroad is not offered.


6.2 Swiss Chocolate Chalet Online-Shop is not liable for delivery delays beyond its control, e.g. due to force majeure, traffic jams, bad weather conditions, etc. Such delays do not entitle the customer to withdraw from the purchase contract or claim damages.


6.3 If not all ordered products are in stock, the Swiss Chocolate Chalet Online Shop is entitled to make partial deliveries.


6.4 If delivery of the goods fails due to the customer’s fault despite three delivery attempts, Swiss Chocolate Chalet Online-Shop may withdraw from the contract. Any payments already made will be refunded without delay.


7. Payment terms


7.1 Payment must be made in advance by credit card.


7.2 Set-off against any counterclaims by the customer is not permitted.

8. Shipping within Switzerland


8.1 Shipping within Switzerland

A Post Priority; delivery within Switzerland takes approx. 1–2 days.


8.4 Shipping for orders placed on Saturdays, Sundays and public holidays

If your order arrives on a Saturday, Sunday or public holiday, it will be delivered on the next working day but one. We recommend placing your order as early as possible (ideally 4–5 working days before your desired delivery date). Please allow for longer delivery times before public holidays.


8.5 Shipping costs

Shipping costs include postage and packaging. They are calculated individually based on the destination (delivery/shipping zone) and weight, can be found under Shipping Information and are displayed before you complete your order.


9. Retention of Title


The goods remain the property of Swiss Chocolate Chalet Online-Shop until payment has been made in full and they have been handed over for dispatch.


10. Right of Withdrawal


10.1 Consumers have the right to cancel their order within 10 days of receiving the goods. The deadline is met when the notice of cancellation is sent. No reason for cancellation is required. 10.2 The right of withdrawal is excluded for the following products:


  • Goods made to the customer's specifications
  • Goods clearly made to the customer’s personal requirements
  • Goods that can spoil quickly
  • Goods whose expiry date would pass


11. Warranty


11.1 Swiss Chocolate Chalet Online Shop provides a warranty by remedying defects. This is done at the discretion of Swiss Chocolate Chalet Online Shop by subsequent performance, namely by eliminating a defect (repair) or by delivering a defect-free item (replacement).


11.2 If supplementary performance fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer has no right to a price reduction.


11.3 The recipient must check the goods for completeness and condition immediately upon receipt. Any complaints regarding quality or completeness must be reported to the Swiss Chocolate Chalet Online Shop without delay, and no later than 24 hours after delivery. Otherwise, the delivery will be deemed accepted.


11.4 The Swiss Chocolate Chalet Online Shop is not liable for transport damage or damage resulting from improper storage of the goods after they have been received by the customer or their agents.


12. Liability


Swiss Chocolate Chalet Online-Shop excludes liability for breaches of contract caused by slight negligence. The same applies to breaches of contract by its assistants and agents.


13. Governing Law


13.1 The contracts are governed exclusively by Swiss law.


13.2 The exclusive place of jurisdiction, subject to the right of appeal to the Swiss Federal Supreme Court in Bern, is Interlaken


14. Final provisions


If any provision of these Terms and Conditions is invalid, the remainder of the contract shall remain in force. The applicable statutory provisions shall apply in place of the invalid provision.


This English version is provided for convenience only. In the event of any discrepancy, the German version shall prevail.
