Terms and Conditions (GTC)


1. Scope


1.1 These General Terms and Conditions apply to all orders placed by customers via the Choco Chalet AG website www.chocochalet.ch. Please read these terms and conditions carefully before ordering any products from this website. By ordering our products, you agree to the following provisions.


1.2 Please click on the “I agree to the terms and conditions” button at the end of the ordering process if you agree to these general terms and conditions. Please understand that if you reject these terms of sale and delivery, you will not be able to order any products from this website.


2. Offer and conclusion of contract


2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order.


2.2 By clicking on the [Order with obligation to pay] button, the customer places a binding order for the products listed on the order page. After the order has been sent, the customer can no longer make any changes to the order.


2.3 Immediately after receiving the order, Swiss Chocolate Chalet online shop will confirm receipt of the order by email. The purchase contract is only concluded when the Swiss Chocolate Chalet online shop confirms the dispatch of the goods by e-mail (order or dispatch confirmation), or at the latest when the goods are delivered.


3. Status


3.1 By placing an order through our website, you warrant that you are capable of entering into legally binding contracts and are at least 18 years old.


4. Prices


4.1 The prices stated on the product page include the statutory VAT and other price components and are in Swiss francs (CHF).


4.2 The prices for the products offered apply that are listed on the day the customer places the order. The prices are binding until the order is confirmed by the Swiss Chocolate Chalet online shop or for the period specified in the order confirmation.


4.3 We reserve the right to change prices as a result of changes in taxes, fees, charges or shipping costs.


5. Shipping Costs


The items ordered are delivered at the customer's expense. The shipping costs consist of postage and packaging costs. They can be viewed in detail at any time via the shipping information page/link and are displayed for domestic deliveries before the order is completed.


6. Terms of Delivery


6.1 Delivery takes place throughout Switzerland, delivery abroad is not planned.


6.2 Swiss Chocolate Chalet Online Shop is not liable for delays in delivery for which it is not responsible, e.g. due to force majeure, traffic jams, bad weather conditions, etc., and they do not entitle the customer to withdraw from the purchase contract or to claim damages.


6.3 If not all ordered products are in stock, Swiss Chocolate Chalet Online Shop is entitled to make partial deliveries.


6.4 If the delivery of the goods fails through the fault of the customer despite three delivery attempts, Swiss Chocolate Chalet Online Shop can withdraw from the contract. Any payments made will be refunded immediately.


7. Terms of Payment


7.1 Payment must be made in advance by credit card.


7.2 Offsetting against counterclaims by the customer is excluded.

8. Shipping Switzerland


8.1 Shipping Switzerland

A Post Priority, the delivery time in Switzerland is approx. 1-2 days.


8.4 Dispatch for orders placed on Saturdays, Sundays and public holidays

If the order arrives on a Saturday, Sunday or holiday, it will be delivered on the next but one working day. We recommend placing your order as early as possible (if possible 4-5 working days before the desired delivery date). A longer delivery period must be accepted before public holidays.


8.5 Shipping Costs

The shipping costs consist of postage and packaging costs. They are calculated individually according to destination (delivery/shipping zone) and weight, can be viewed under shipping information and are displayed before the order is completed.


9. Retention of Title


The goods remain the property of Swiss Chocolate Chalet Online Shop until full payment has been made and the goods have been dispatched.


10. Right of Withdrawal


10.1 Consumers have the right to cancel the contract declaration within 10 days of receipt of the goods. The time at which the revocation was sent is decisive for meeting the deadline. 10.2 The right of withdrawal is excluded for the following products:


    Goods that are made to customer specifications. Goods that are clearly tailored to personal needs. Goods that can spoil quickly. Goods that have passed their use-by date


11. Warranty


11.1 Swiss Chocolate Chalet online shop provides a guarantee by remedying defects. This is done at the discretion of Swiss Chocolate Chalet Online Shop through supplementary performance, namely elimination of a defect (repair) or delivery of a defect-free item (replacement delivery).


11.2 If the supplementary performance fails, the customer is entitled to withdraw from the contract. This does not apply to insignificant defects. A right of the customer to reduction is excluded.


11.3 The recipient undertakes to check the goods for completeness and condition immediately upon receipt. Any complaints regarding quality and completeness must be reported to the Swiss Chocolate Chalet online shop immediately, but no later than within 24 hours of delivery. Otherwise the delivery is considered accepted.


11.4 Swiss Chocolate Chalet Online Shop is not liable for transport damage and damage resulting from improper storage of the goods after acceptance by the customer or his assistants.


12. Liability


Swiss Chocolate Chalet online shop excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by assistants and substitutes.


13. Governing Law


13.1 Swiss law is exclusively applicable to the contracts.


13.2 The exclusive place of jurisdiction is Interlaken, subject to appeals to the Swiss Federal Court of Bern


14. Final Provisions


Should a provision of these general terms and conditions be ineffective, the rest of the contract remains effective. The relevant statutory provisions shall apply in place of the ineffective provision.
